64. Disclaimer

    If selling food or edible products, everything must be prepackaged. Everyone participating will be allotted one 6ft table and 2 chairs. If bad weather occurs a notice will be sent out before the event with our event “rainy day” policy. Application Process: City of Dallas officials review all applications and will contact applicants with additional questions, approval, wait list information. Dallas Parks and Recreation has the right to refuse any exhibitor/vendor to sell their products or market their services, if the item is not determined safe or appropriate for this event. Qualified applications will be placed on a waiting list once the market has reached full capacity. Application does not guarantee vendor acceptance. Vendors shall supply all their own materials and containers for customer sales as well as set up, such as canopies, posters/banners, extra tables and chairs. No firearms, alcoholic beverages or drugs will be sold or allowed at the event. Vendors will have 2 weeks to pay for their vendor book once being notified they have been approved.

66. Vendor Acknowledgement*

    I, the undersigned, certify the statements made by me are true, complete, and correct to the best of my knowledge. I agree to abide by the rules as stated in the “Dallas Park and Recreation Food Safety Guidelines”. I understand any misstatement or omission of facts in this application may be cause for rejection of this application and/or cancellation of a prior approval of an application. I, the undersigned, understand and agree to keep and maintain my vendor space(s) and all areas in and about said vendor space(s) clean and free of debris and any conditions that might potentially result in or cause injury to myself and any other persons or parties. I also understand and agree I am solely responsible and assume entire responsibility and liability for any claim or actions based on or arising out of injuries, including death, to persons, or damages to or destruction of property, sustained or alleged to have been sustained in connection with or to have arisen out of or incidental to the condition and quality of any and all products, produce, wares and matters of any kind that I produce, market, display, serve and/or sell at, about or through the event.

68. Hold Harmless Clause*

    I hereby forever release and discharge the City of Dallas, its officers, agents and employees (“releases”), in both their public and private capacities, from any and all actions, causes of action, claims, demands, damages, costs, loss of services, expenses (including, without limitation, attorney’s fees, court costs, consultant fees, expert fees, and other litigation related expenses) and compensation on account of, or in any way growing out of, any and all known and unknown personal injury and property damage (including but not limited to any negligence claims and wrongful death claims pursuant to section 71.021, Texas Civil practice and remedies code, as amended) resulting or to result from the event or reservation.  I further agree, in consideration of the permission granted above, never to file a claim, lawsuit or other proceeding, whether, judicial or administrative, against the releases for me or by any other persons (including but not limited to any negligence claims or wrongful death claims pursuant to section 71.021, Texas civil practice and remedies code, as amended) that may arise or result form the event or reservation.

70. Indemnity Clause*

    I further agree to defend, indemnity and hold the City of Dallas, its officers, agents and employees, harmless against any and all claims, lawsuits, judgments, costs and expenses for personal injury (including death), property damage or other harm for which recovery of damages is sought, suffered by any persons, that may arise out of or be occasioned by the conduct, management, or operation of the event; except that the indemnity provided for in this paragraph shall not apply to any liability resulting from the sole negligence or fault of the City of Dallas, its officers, agents, employees or separate contractors, and in the event of joint and concurring negligence or fault of mine and the City of Dallas, responsibility and indemnity, if any, shall be apportioned in accordance with the law of the State of Texas, without waiving any governmental immunity available to the City of Dallas under Texas law and without waiving any defenses of the parties under Texas law.   The provisions of this paragraph are solely for the benefit of the parties hereto and not intend to create or grant any rights, contractual or otherwise, to any person or entity.  The indemnification shall also include costs of defense, which shall be an attorney of the City of Dallas’ choice, court costs, expert witness fees, and any judgment together with pre-judgment and post-judgment interest. The City of Dallas does not assume any responsibility for any property placed on or in its facilities or grounds.

72. Lost or Stolen Property*

    I acknowledge and agree the City of Dallas shall not be liable for any lost, stolen and/or damaged property, materials, equipment, produce, goods, and any other items associated and/or used in conjunction with the market. I hereby release the City of Dallas and their Officials, Officers, Board of Directors, Agents, Representatives and Employees from, and waives any and all rights to any and all claims for damages, or otherwise, I may have with regard to lost, stolen and/or damaged property, materials, equipment, produce, goods and any other items associated and/or used in conjunction with the market.

74. Photo / Video Release*

    I expressly give and grant to the CITY the unqualified right, privilege, and permission to reproduce, publish, and circulate in every manner or form (including radio, television, newspapers, magazines, and the internet) video tapes, films, photographs, transparencies, and other images and likenesses of me, my child(ren), family, and/or property and audio recordings of my, and their voices (collectively referred to as “video and audio recordings”) , and I hereby grant, assign and transfer to the CITY all rights and interest therein at no charge. I specifically authorize and empower the CITY to cause any such video and audio recordings, to be copyrighted or in any other manner to be legally registered in the name of the CITY. I, for myself, my family, my child(ren), my heirs, executors, administrators and assigns, hereby remise, release, and discharge the CITY from any and all claims of any kind due to the use of such video and audio recordings, including all claims for damages or injunctive relief for libel, slander and invasion of the right of privacy.
